Grayscale, a16z, and CCI Advocate for Tailored ETF Regulations to SEC

Grayscale Investments, Andreessen Horowitz (a16z), and the Crypto Council for Innovation (CCI) have submitted comments to the Securities and Exchange Commission (SEC) urging the agency to maintain its existing classification frameworks for exchange-traded products (ETPs). This response comes after the SEC's Request for Comment on Novel ETFs, published on June 30, 2026, which sought input from the crypto industry regarding regulatory approaches to new ETPs.

The three organizations argue against a blanket regulatory approach that treats all novel ETPs as identical. Grayscale, which manages a significant digital asset fund platform, highlighted its vested interest in the outcome, having launched various digital asset ETPs such as GBTC and ETHE. a16z emphasized the importance of innovation in the sector, while CCI focused on the competitive implications of overly restrictive regulations, suggesting that such measures could hinder the development of new products in the U.S. market compared to other jurisdictions.

All three entities proposed that differentiated review processes could expedite approvals for new products without compromising investor protections. This comes in light of the SEC's 2025 approval of generic listing standards for qualifying commodity-based ETPs, which streamlined the approval process for certain digital asset products, benefiting firms like Grayscale. The recent SEC request indicates a potential shift in how the agency may regulate the next generation of ETPs.
