      U.S. House Committee Approves First Federal Cryptocurrency Tax Framework

      The House Committee on Ways and Means has approved the "Digital Asset Tax Clarification Act" with a vote of 38 in favor and 5 against, marking the establishment of the first federal tax framework for digital assets in the United States. The legislation sets a threshold for taxation, exempting cryptocurrency transactions with network or transaction fees not exceeding $10. However, this exemption does not extend to service providers conducting transactions on behalf of others, and the provisions will not take effect until December 2027.

      Additionally, the bill mandates the U.S. Department of the Treasury to create a voluntary disclosure program for digital assets within 12 months of the bill's enactment. This program will allow eligible taxpayers to amend previous filings and settle any owed taxes, interest, and penalties. Income generated from mining and staking will be taxed as ordinary income, while certain investment trusts will be permitted to stake without impacting their tax status. Notably, a previous provision for deferred income recognition has been removed, leaving the timing of income recognition unresolved.

      Committee Chairman Jason Smith described the vote as a historic moment for the committee. This development follows a failed procedural vote in the Senate on the "Clarity Act," which was opposed by Democrats due to ethical concerns related to former President Donald Trump's cryptocurrency interests. The House is set to recess until after the November elections, with the possibility of the bill advancing during the lame-duck session, as public attention shifts to the Senate Finance Committee.
