Florida Emerges as Key Battleground for AI Regulation

Florida is becoming a focal point in the national debate over artificial intelligence regulation as political action committees and lobbying groups intensify their efforts to influence state governance. The state's approach, highlighted by Governor Ron DeSantis's proposed AI Bill of Rights, has attracted significant attention from the AI industry. This bill, introduced on December 4, 2025, aims to establish consumer protections, data privacy measures, and consent requirements regarding the use of personal likenesses in AI applications.

In addition to the AI Bill of Rights, Florida's legislative efforts include the unanimous passage of SB 484, which regulates energy consumption in AI data centers. Furthermore, HB 919, effective July 1, 2024, mandates disclaimers on political advertisements that utilize generative AI content. These measures reflect a growing awareness among legislators about the implications of AI technologies, particularly concerning consumer protection and the risks associated with deepfakes and unauthorized image use.

The lobbying landscape in Florida is marked by the involvement of TechNet, a prominent industry group advocating for major technology companies. TechNet's political action committee is actively engaging in discussions around AI regulation, particularly in the insurance sector, where the balance between consumer protection and innovation is a contentious issue. While some industry representatives argue that generative AI enhances fraud detection, others caution that excessive regulation could hinder beneficial tools.

The regulatory developments in Florida are significant not only for the state but also for the broader landscape of AI legislation across the United States. As all 50 states introduce AI-related laws, the potential for a fragmented regulatory environment looms, complicating compliance for companies, especially those planning new data center projects in Florida.
