      CFTC Implements Automatic 30% Whistleblower Awards for Cases Under $5 Million

      On September 11, 2026, the Commodity Futures Trading Commission (CFTC) approved a new rule that establishes a rebuttable presumption for whistleblower awards, allowing eligible individuals to receive a statutory maximum of 30% from monetary sanctions in cases where the total award is $5 million or less. This change is expected to streamline the process for the majority of whistleblower claims, as approximately 82% of all cases historically fall within this financial threshold.

      Previously, whistleblower awards were determined on a case-by-case basis, which often prolonged the resolution process. The new rule shifts the default to favor whistleblowers, making it easier for them to receive compensation. However, the presumption does not apply if the whistleblower is found to have contributed to the misconduct or if there is an unreasonable delay in reporting the misconduct.

      CFTC Chairman Michael S. Selig highlighted that this regulatory change aims to enhance efficiency and accountability, thereby increasing transparency for potential whistleblowers. The CFTC's whistleblower program, operational since 2014, has awarded over $430 million to whistleblowers, leading to more than $3.7 billion in total monetary sanctions from successful enforcement actions. The program is funded through the CFTC’s Customer Protection Fund, ensuring that whistleblower payouts are kept separate from customer assets.
