Super Micro Investigation Clears Management of Nvidia Chip Diversion Allegations
Super Micro Computer announced the completion of an independent investigation on August 20, 2026, which found no evidence that current senior management was aware of an alleged scheme to divert Nvidia-equipped AI servers to China. The investigation was initiated following a federal indictment unsealed on March 19, 2026, charging three former associates of the company, including co-founder Yih-Shyan 'Wally' Liaw, with conspiring to funnel approximately $2.5 billion worth of servers in violation of U.S. export controls.
The inquiry, overseen by Lead Independent Director Scott Angel and Audit Committee Chair Tally Liu, examined transactions related to the indictment as well as broader sales of restricted products. The findings confirmed that there were no direct sales to restricted parties and no management complicity, allowing Super Micro to reaffirm the reliability of its prior financial statements.
In June 2026, Taiwanese authorities conducted raids on Super Micro's offices as part of the ongoing investigation, raising concerns among investors. The company has since severed ties with the indicted individuals, who no longer have any relationship with Super Micro. Although the company itself has not been charged, the allegations have posed significant challenges to its credibility, especially following past scrutiny and a temporary delisting from Nasdaq in 2018 due to late financial filings.
Moving forward, Super Micro plans to enhance its export compliance program, acknowledging the need for stronger controls to prevent similar issues, despite the investigation clearing current management. The federal case against the indicted individuals is ongoing, and developments in that case may lead to further scrutiny of the company.
