It does not pass the CLARITY Act, and it does not fix the final text. According to the sponsors' own release, "if cloture is invoked on the motion to proceed on Tuesday afternoon, this legislative text would be offered as an Amendment in the Nature of a Substitute" - meaning the 14 September draft becomes the version the Senate debates and amends from there.
The arithmetic is the whole story. With 53 Republican seats, the bill needs at least seven votes from across the aisle even if every Republican votes yes, and crypto.news coverage on 4 September named Rand Paul and Josh Hawley as expected Republican no votes, which would push the Democratic requirement toward nine. Senator Thom Tillis had conditioned his support on stronger ethics language - the language the final text now says it includes.

The ethics piece rests on the White House: FinanceFeeds reported yesterday that Trump agreed to 80% of the stricter ethics rules tied to the bill.
Democrats answered with a counteroffer, not a yes. Senate Democrats delivered it to Republican negotiators late on Monday, and its text had not been released as of early Tuesday (Politico's Jasper Goodman, via crypto.news). CoinDesk reports the open points sit in the ethics section: concern that the revised language would still block state attorneys general from suing the president directly, and that it lets the Office of Government Ethics issue notices allowing senior officials to keep crypto business ties. Why the bear case is not lower: a failed cloture vote does not formally kill H.R.3633 - leadership can bring the motion back - and XRP's demand this year has not depended on the bill.
