      Cryptocurrency Lobbying Groups Challenge Illinois Digital Asset Tax in Court

      The Crypto Innovation Committee (CCI) and the Blockchain Association have filed a motion for a preliminary injunction in the Sangamon County Circuit Court in Illinois, seeking to halt the enforcement of a new digital asset transaction tax. This tax, set at a rate of 0.2%, is scheduled to take effect on January 1, 2027, and applies to businesses based in Illinois or providing services within the state that generate total revenues exceeding $100,000.

      The lawsuit, initiated last month, argues that the tax contravenes the Internet Tax Freedom Act and the U.S. Constitution. The lobbying groups contend that Illinois's approach to taxing digital assets is inconsistent with the treatment of other financial services. CCI CEO Ji Hun Kim emphasized the financial burden on businesses, which are required to invest millions in compliance systems, while expressing concerns over the lack of clarity regarding the tax's subjects and timing.

      Summer Mersinger, CEO of the Blockchain Association, cautioned that if Illinois successfully implements this tax, it could set a precedent for other states to follow suit. The outcome of this legal challenge may have significant implications for the cryptocurrency industry and its regulatory landscape across the United States.
