      Sweden's Tax Authority Demands $56 Million from Crypto Miners for Invalid Tax Breaks

      Sweden's tax authority, Skatteverket, has issued demands totaling approximately $56.5 million against six cryptocurrency mining companies based in Boden, a city in northern Sweden known for its energy-intensive computing operations. This enforcement action is part of a broader audit that spans from 2024 to 2026, targeting nine companies across the country for alleged tax violations related to their operational structures and reporting practices.

      The mining firms are accused of improperly claiming tax incentives intended for conventional data centers, as well as value-added tax (VAT) deductions, despite not meeting the necessary criteria outlined in Swedish law. Regulators assert that these companies constructed their corporate frameworks to appear eligible for these benefits when they were not, contributing to an estimated $100 million in lost revenue for Sweden's public finances due to discrepancies in crypto mining taxes.

      Among the companies involved is Bikupan Datacenter, the Swedish subsidiary of HIVE Digital Technologies, which has appealed its assessment to Sweden's Supreme Administrative Court. The CEO of Bikupan, Johanna Törnblad, contends that the company should not be classified as a mining operation, arguing that it merely provided computing resources while independent pools conducted the actual mining. HIVE has recognized an $84.7 million non-cash provision related to its VAT disputes in Sweden, significantly impacting its financial standing and prompting a shift in focus towards artificial intelligence and high-performance computing.

      This multi-year audit and the ongoing legal battles signal a significant institutional approach to regulating the crypto mining sector in Sweden. The outcome of the Supreme Administrative Court case involving Bikupan is expected to influence how tax claims related to cryptocurrency mining are handled in the future, potentially affecting investors in publicly traded mining companies with exposure in Europe.
