      Minnesota Defends AI Nudification Ban Amid Lawsuit from xAI

      Minnesota is standing firm on its new law banning AI-generated nonconsensual intimate imagery, following a lawsuit from Elon Musk's AI company, xAI. The law, known as HF 1606, took effect on August 1 and prohibits the creation or sharing of AI-generated images or videos depicting identifiable individuals in a sexualized manner without their consent. Violators of this law could face penalties of up to $500,000.

      In response to xAI's lawsuit, which claims the law violates the First Amendment, Attorney General Keith Ellison filed a court response on August 17. Ellison's office argues that the law is a narrowly tailored measure aimed at addressing the specific issue of image-based sexual abuse, rather than a broad attack on AI creativity or free speech. The lawsuit was filed in the US District Court for Minnesota, where xAI sought a temporary restraining order to block the law, but this request was denied by Judge Donovan Frank on July 31.

      The law has garnered support from victim advocacy groups, who view it as a necessary step to protect individuals from abuse in a rapidly evolving technological landscape. However, some free-speech organizations have raised concerns about the law's potential overreach, suggesting that its language could inadvertently restrict legitimate artistic or journalistic uses of AI-generated content. The upcoming hearing on August 19 will address xAI's motion for a preliminary injunction, which could provide insight into how federal courts may interpret the constitutionality of such bans.
