SEC Approves Trading of Tokenized Securities in the US Market

On September 17, 2026, the U.S. Securities and Exchange Commission (SEC) announced the approval of a temporary "Innovation Exemption" that allows for the trading of tokenized versions of U.S. equities on blockchain-based platforms. This regulatory decision comes in the wake of stalled crypto legislation in the Senate, particularly the failed CLARITY Act, which aimed to establish a comprehensive framework for digital assets.

The exemption permits newly designated Tokenized Securities Venues (TSVs) to facilitate on-chain trading of stocks listed in the Russell 1000 index and certain exchange-traded funds (ETFs). These tokenized securities must maintain the same rights as their traditional counterparts, including dividends and voting rights. The exemption is set to last for five years, during which TSVs must adhere to U.S. person verification, sanctions screening, and public reporting requirements.

SEC Chairman Paul S. Atkins described the exemption as a significant advancement in modernizing capital markets. The SEC's move to implement this exemption without congressional approval reflects a proactive approach to fill the regulatory gap left by the stalled legislation. The Commission is also seeking public feedback on the exemption to inform future regulatory decisions.

The introduction of tokenized securities is expected to benefit both retail and institutional investors. Retail investors may gain access to fractional ownership and self-custody options, while institutional players could see a reduction in trade settlement times, potentially moving from the current T+1 standard to near-instantaneous finality. This shift could free up capital that is currently tied up in clearing and margin requirements.
