CFTC Proposes Regulation for Computing Power as a Commodity

The Commodity Futures Trading Commission (CFTC) is moving to regulate computing power as a commodity, likening it to traditional resources such as crude oil. CFTC Chairman Michael S. Selig emphasized the importance of compute as a critical resource for advancing artificial intelligence during an event at the White House in August 2026.

On August 19, 2026, the CFTC initiated a 60-day public comment period regarding the oversight of compute derivatives, inviting industry stakeholders to provide input on the emerging market. This initiative aligns with the broader White House AI Action Plan, which aims to position the United States as a leader in AI technology.

The CME Group plans to launch futures contracts on October 5, 2026, which will track the monthly rental costs of Nvidia's H100 and Blackwell B200 chips. This development could create a new asset class for institutional investors, allowing them to gain exposure to the AI sector without investing in individual companies. The CFTC's focus on price discovery and risk management will be crucial as the industry navigates the implications of trading computing power as a commodity.
