South Korean Investors Seek Delay in Cryptocurrency Tax Amid Regulatory Resistance

South Korean investors are advocating for a postponement of the cryptocurrency capital gains tax set to take effect on January 1, 2027. This marks the fourth petition submitted to delay the tax, which has now gathered 50,000 valid signatures through the National Assembly's electronic petition system, meeting the threshold for legislative review. Despite this push from investors, regulators are determined to implement the tax as planned.

The proposed tax includes a 22% levy, comprising a 20% basic tax rate and an additional 2% local tax, applicable to annual income from digital assets exceeding 2.5 million Korean won (approximately $1,856). This tax applies to income generated from the sale, transfer, and lending of cryptocurrency. The tax has faced multiple delays since its initial proposal in 2022, with investors citing significant losses in the crypto market as a reason for their request. Major South Korean cryptocurrency firms have reported declines in operating profits of up to 90%.

Petitioners argue that enforcing the tax now could hinder young investors' financial prospects and potentially drive them to seek offshore trading platforms. Earlier this year, a petition aimed at abolishing the crypto tax also reached the 50,000 signature mark within eight days but did not progress further. The government, however, remains steadfast in its approach, with Lee Heung-ik, the nominee for the Minister of Economy and Finance, reaffirming that the tax plan will proceed as scheduled, and the National Tax Service is expected to release detailed tax standards later this year.
